Justice Mohammed Garba Umar of the Federal High Court in Abuja has ordered activist and African Action Congress presidential candidate Omoyele Sowore back to Kuje Correctional Centre. The court will rule on his bail application on June 30, 2026.
The judge adjourned on Wednesday after both sides adopted their arguments. Sowore’s legal team, led by R.O. Adakole and C.S. Etonyeaku standing in for Adeyinka Olumide-Fusika SAN, had filed a motion on June 19 asking the court to set aside the June 16 order that revoked his bail and issued a bench warrant. They’re basically asking for things to go back to how they were, with his previous bail conditions restored.
The defence is leaning on a 34-paragraph affidavit by Emmanuel Larry and a “better” 36-paragraph one by Sodiq Temitope filed on June 24. Their argument? Grant the application “in the interest of justice” and toss out the prosecution’s affidavit.
On the flip side, the Federal Government’s counsel Akinlolu Kehinde SAN isn’t having it. He filed a 25-paragraph counter-affidavit and told the court Sowore “has not placed truthful facts” before the court to warrant bail. He wants the application refused.
Quick backstory: On June 16, the court revoked Sowore’s bail and issued a bench warrant because he didn’t show up for his trial. The DSS is prosecuting him for alleged criminal defamation and cybercrime — all over posts on his X and Facebook accounts where he allegedly referred to President Bola Tinubu as a “criminal.” Sowore has pleaded not guilty.
Now, after Wednesday’s adjournment, his lawyers tried to get him released to them until June 30. They even mentioned he was “in a bad state of health.” But the prosecution called the oral request “a little bit absurd” and said it should’ve been filed formally.
Justice Umar wasn’t convinced either. He said granting it would defeat the point of adjourning to write his ruling, especially since he hadn’t even gone through all the filings yet. So, back to Kuje Sowore goes until the court reconvenes on June 30.
