The African Democratic Congress faction led by David Mark has asked a Federal High Court in Abuja to reverse a decision by Independent National Electoral Commission removing its leadership from official records.
In a motion filed on April 7, Mark urged the court to set aside INEC’s action deleting his name as national chairman and that of Rauf Aregbesola as national secretary from its portal.
Mark also asked Justice Emeka Nwite to compel INEC to restore the names of the party’s National Working Committee and to recognise its leadership pending determination of the suit.
The application follows a March 12 ruling by the Court of Appeal which ordered parties to maintain the status quo ante bellum in a dispute filed by Nafiu Bala Gombe.
Mark’s lawyer, Sulaiman Usman, argued that INEC misinterpreted the appellate court’s directive by removing the leadership, creating what he described as a vacuum in the party’s structure.
He said the court has the power to grant a mandatory injunction to restore a position wrongfully altered and prevent actions that could render the case nugatory.
The motion also seeks accelerated hearing of the case, citing its impact on the party’s administration and participation in political activities.
