The Attorney General of the Federation and Minister of Justice, Lateef Fagbemi, SAN, has taken over the prosecution of former AGF Abubakar Malami and his son, Abdulaziz, in a five-count charge bordering on alleged terrorism and illegal possession of firearms filed by the Department of State Services (DSS).
The development was disclosed by the Director of Public Prosecutions of the Federation, Rotimi Oyedepo, SAN, when the case came up before Justice Joyce Abdulmalik at the Federal High Court sitting in Abuja.
“My lord, I was informed by counsel to the DSS that the case file has been transmitted to the office of the Attorney General of the Federation,” Oyedepo told the court.
Following the update, the prosecution requested an adjournment to allow the AGF review the case file and decide on the next course of action.
CBI News reports that counsel for the defendants, Adedayo Adedeji, SAN, did not oppose the adjournment but stated that if the matter does not proceed at the next sitting, he would apply for the charge to be struck out.
Responding, the prosecution described the defence’s position as premature, arguing that the request for striking out the charge at this stage was speculative.
After hearing both parties, Justice Joyce Abdulmalik adjourned the matter till March 10, 2026, for trial.
At the previous hearing, the court granted bail to Malami and his son in the sum of N200 million with two sureties each in like sum.
However, they were remanded at the Kuje Correctional Centre pending the perfection of their bail conditions.
Among the bail requirements are that each defendant must produce two sureties who own landed property in either the Maitama or Asokoro districts of Abuja.
The title documents of the properties are required to be deposited with the Deputy Chief Registrar of the court alongside valid international passports.
The sureties are also required to swear affidavits of means and submit recent passport photographs.
Additionally, Malami and his son must surrender their international passports and passport photographs to the court.
The DSS is prosecuting both defendants on allegations that include knowingly aiding terrorism financing and unlawful possession of firearms.
In Charge No. FHC/ABJ/CR/63/2026, Malami is accused of allegedly refusing to prosecute suspected terrorism financiers while serving as AGF.
Both he and his son are also accused of storing firearms including a Sturm Magnum 17-0101 rifle, 16 Redstar AAA 5720 live cartridges, and 27 expended cartridges at their residence in Gesse Phase II Area, Birnin Kebbi, without lawful authority, contrary to provisions of the Terrorism (Prevention and Prohibition) Act, 2022 and the Firearms Act, 2004.
