Fresh drama has erupted in the African Democratic Congress (ADC) leadership tussle after a Federal High Court in Abuja indefinitely adjourned the case following a controversial request by the plaintiff to transfer the matter to another judge.
CBI News notes that Justice Emeka Nwite suspended proceedings after both parties clashed over a letter sent to the Chief Judge of the Federal High Court seeking reassignment of the suit.
The plaintiff’s legal team argued that the request should await administrative consideration, while defence lawyers accused the plaintiff of “forum shopping” and attempting to frustrate the accelerated hearing earlier ordered by the Court of Appeal and upheld by the Supreme Court.
The court ruled that no action could be taken on the request without hearing all parties, stressing that doing otherwise would breach the defendants’ fundamental rights.
The matter has now been adjourned sine die pending further directives from the Chief Judge and the filing of the Certified True Copy of the Supreme Court judgment.
